PESHAWAR: A policeman on Friday beat Khyber Union of Journalists Senior Vice President Mohammad Naeem black and blue inside the Khyber Pakhtunkhwa Assembly building here using butt of official rifle.

Mr Naeem was later shifted to the Lady Reading Hospital, where doctors said the journalist had a fracture of shoulder and breathing problems mainly due to excessive bleeding from nose.

The incident occurred after altercation over the removal of a barbed-wire fence.

The injured journalist said he had asked Constable Nasrullah of East Cantonment police station to remove the barbed wire from the parking area designated for media after his identity card was checked but the latter declined.

“My only sin, which led to my torture, was that I asked the cop that if it’s not his duty to let journalists park cars at the designated place, then why he was checking their identity cards,” he said.

Mr Naeem claimed the constable also tried in vain to fire gunshots at him as journalist Adeel Saeed standing nearby snatched his official rifle.

When contacted, SSP (Operations), Peshawar Najeebur Rehman said he had suspended the policeman and ordered a departmental probe into the incident.

“We have also initiated a departmental inquiry into the matter. Action against the constable will depend on the medico-legal report of the case,” he said.

Meanwhile, Speaker of the provincial assembly Asad Qaisar announced to form of committee to look into the incident.

The committee comprising Information Minister Shah Farman, Zakat and Ushr Minister Habibur Rehman, and opposition MPAs Miraj Hamayun, Sardar Aurangzeb Nalota and Syed Jaffar Shah will meet on Monday to examine the CCTV footage of the incident and record statements of the relevant people before submitting a report to the speaker for necessary action.

Later in the day, journalists went to Lady Reading Hospital in large numbers to inquire after Mr Naeem.

They also held an informal meeting at the hospital and condemned the constable’s conduct and demanded strict action against him.

The participants, including KhUJ President Nisar Mehmood and Peshawar Press Club President Nasir Hussain, also decided not to cover the provincial assembly session and police activities.

They decided to hold a joint emergency meeting of KhUJ and PPC general bodies at the press club today (Saturday) to decide future course of action.

PESHAWAR: The Khyber-Pakhtunkhwa (K-P) Assembly unanimously passed the K-P Right to Information Act (RTI) 2013 on Friday, but not without significant amendments. One such change pertains to ‘mala fide intentions’ which are now counted a punishable offence resulting in – at most – a Rs50,000 fine or incarceration for two years.

During the session chaired by Assembly Speaker Asad Qaiser, Minister for Information Shah Farman presented the bill on the assembly floor. The passage was supported unanimously with amendments based on the select committee’s recommendations from their earlier meetings. The K-P RTI Ordinance 2013 stands revoked after the passage of this bill.

“The RTI Act will make the government accountable on a daily basis to the people,” said Farman. Now people will not have to wait for elections to hold a government accountable, maintained the information minister.

Penalising freedom of information

“The act will make people stakeholders in the government as it will keep a check on the latter,” said Farman. However, this stake comes with a rather ominous caveat. He told the assembly, “Whosoever will use the law for mala fide intentions, we have made a provision to render it a crime.”

He was referring to the offence section of the K-P RTI Act 2013. In addition to other ‘wrongdoings’, clause 28 declares it is a criminal offence to wilfully “use the information obtained [under the RTI act] for mala fide purposes with ulterior motives.”

The clause further states, “anyone who commits an offence under sub-section (1) shall be liable to a fine not exceeding Rs50,000 or imprisonment for a period not exceeding two years.”

The RTI Act 2013 also contains exemptions regarding information sharing. Types of information which can be exempted from being shared with the public includes topics related to ‘international relations and security’, ‘disclosure harmful to law enforcement’, ‘public economic affairs’, ‘public money’, ‘privacy’, ‘legal privilege’, and ‘commercial and confidential information’.

The bill was not debated on the assembly floor as it was presented by a select committee comprising both opposition and treasury benches members. The committee incorporated 11 amendments and the assembly agreed to pass it without a clause-wise passage of the act or debate.

During the assembly session on 16th September – on a motion moved by Shah Farman – the house had referred the K-P RTI Bill 2013 to the select committee. With Minister for Information Farman as its chairman, its members included the late minister for law Israrullah Gandapur, deputy speaker Imtiaz Shahid Qureshi and lawmakers Syed Jafar Shah, Shah Hussain, Arbab Akbar Hayat, Ziaullah Bangash, Qurban Ali Khan, Samiullah Alizai, Muhammad Ali and Aamna Sardar.

The select committee held three meetings on October 3, October 7 and October 25 at the K-P Assembly Secretariat to examine and tweak the bill.

Early readings of the act suggest amendments other than clause 28 might not be as significant as the changes envisaged in the draft stages.

PESHAWAR: The Khyber Pakhtunkhwa government on Tuesday tabled ‘Right to Information Bill’ in the provincial assembly while the opposition members walked out from the proceedings in protest against ignoring their demand by the government regarding the District Development Advisory Committee (DDAC).

Soon after the recitation from the Holy Quran, newly elected members, including Ahmad Khan Behadar, Jamshid Mohmand from Mardan, Shah Faisal from Hangu and Azam Khan Durrani from Bannu administered oath.

Amid tight security arrangements, the KPK Assembly met with Speaker Asad Qaiser in the chair. The KPK Minister for Information Shah Farman move ‘Right to Information Bill’, if it is passed from the provincial assembly would facilitate the general public and media to get information about provincial government departments.

The opposition benches, including Pakistan PML-N, JUI-F, ANP and PPP lawmakers walked out from the assembly session against not honouring the commitment made by the government with them about DDAC. “The government had assured the opposition about the appointment of their members as chairmen DDAC but they have so far neither been consulted nor taken them into confidence,” PML-N MPA Manawar Khan Marwat said while raising the issue.

They, however, ended their boycott on the request of provincial ministers Yousaf Ayub, Shah Farman Khan, Israrullaha Khan Gandapur and Yaseen Khalil. Meanwhile, KPK Information Minister Shah Farman assured the House that they would take up the issue with the chief minister.

Speaker Asad Qaisar kept the adjournment motion of Qaimous Khan pending till the arrival of minister for health. Minister for Law and Parliamentary Affairs Israrullah Khan Gandapur, who was responding on behalf of the ministers, advised the chair to keep the motion pending till the arrival of minister because they did not want politics on this sensitive issue.

MPA Qaimous Khan observed that the dengue virus had affected thousands of people in Swat and victims were facing problems in hospital due to lack of proper arrangements and facilities.

Similarly, Qaumi Watan Party (QWP)’s Anisa Zeb apprised the House about growing threats of dengue virus. Expressing concern over the ongoing arrangements by government, she said it needs seriousness instead of cosmetic steps.

Taking notice of the absence of minister health and officers in gallery, she directed other members of the cabinet to prepare a list of the absent secretaries so that action could be taken against them with the consultation of the chief minister.

Through a call attention notice, PML-N’s Sardar Aurangzeb Nalota told the House about the recent devastating floods destroying 60 per cent roads in his district, corps and others buildings. The lack of maintenance and repair funds was multiplying miseries of the people.

The ANP’s Sardar Hussain Babak said the government should have provided funds to the DCs for such emergencies like situation. Ushar Zakat Minister Habibur Rehman said that he himself had visited the site but Babak had constructed the Bacha Khan Model School at the bank of canal. This infuriated Babak, saying the ministers should have responded positively instead of criticising him. He said the site had been selected after proper procedure of various government departments.

The PPP Salim Khan urged the government to take practical steps for improving damaged irrigation and communication system in Chitral district.

The PTI’s Yaseen Khalil said that his government has provided Rs.5 million to each DC for immediate relief of the affected people in such emergencies.

He said it was the responsibility of the concerned DCs to provide them the list and the members should also cooperate with them so that problems could immediately be resolved. The ANP’s Jaffar Shah and JUI-F Mufti Janan, PML-N’s Manawar Khan raised the problems of their respective districts complaining against the lack of various facilities.
