KARACHI: The Sindh High Court (SHC) on Tuesday issued notices to the Ministry of Information, Pakistan Electronic Media Regulatory Authority (Pemra) and cable operators on petitions of the Independent Media Corporation seeking action against cable operators for unlawful blocking of Geo Entertainment transmissions.

The Independent Media Corporation moved the SHC against illegal blocking of Geo Entertainment transmissions by the cable operators in the province.Petitioner’s counsel Bahzad Haider submitted that private cable operators did not comply with the orders of Pemra and broadcast of the Geo Entertainment remained suspended since July 20 without any reason.

He submitted that blocking the transmission of Geo Entertainment was a violation of the Supreme Court and High Court’s orders that restrained Pemra and cable operators from blocking or interfering in the smooth transmission of TV channels. The counsel submitted that Pemra had failed to take action against the cable operators who despite the complaint of the petitioner did not restore the transmission of Geo Entertainment.

The court was prayed to direct Pemra to take action against the cable operators for unlawfully blocking the transmission of Geo Entertainment and restrain them from blocking or interfering with the transmission of Geo Entertainment.

The SHC’s division bench, headed by Justice Sajjad Ali Shah, after preliminary hearing of the petition issued notices to the Ministry of Information, Pemra and cable operators and others for August 13.

Pakistan Electronic Media Regulatory Authority (PEMRA) on June 20, 2014 suspended licenses of two private TV channels, ‘Geo Entertainment’ and ‘ARY News’, just hours before the ending of 15-day suspension period of Geo News.

Geo Entertainment has been fined with one-month suspension along with Rs10 million fine, while the license of ARY News is suspended for 15 days and a same fine amount imposed on it.

PEMRA suspended these licenses and imposed fine due to violation of rules, reportedly committed by Geo Entertainment and ARY News. According to PEMRA release, Geo Entertainment is suspended because of airing blasphemous content on its morning show.

The license of ARY News was suspended over complaints about malicious statements against the judiciary on one of its talk shows. This is the second suspension faced by Geo TV network as Geo News was earlier suspended for 15 days by PEMRA in an order issued on June 6, 2014.

Your Excellency:

We are writing to express our deep concern about the deteriorating climate for press freedom in Pakistan, which undermines recent commitments made by your government during CPJ’s mission to the country.

In our meeting with you on March 19, you told us you recognized the scope of the crisis that journalists face in Pakistan and the damage that the country’s record of impunity in journalist murders has done to its international reputation. We were encouraged by the exchange and follow-up we had with you and other Pakistani officials.

We urge you to follow your pledges to address media freedoms with meaningful action. A joint government-media commission to review anti-press attacks and improve security, such as the one you pledged to create, would be a great step toward improving the climate for press freedom in Pakistan.

Since our meetings, conditions for journalists working in Pakistan have drastically deteriorated. Only days after we met, unidentified gunmen fired on the car of Raza Rumi, a senior Pakistani journalist, as he was leaving the studio following his TV show. Rumi was not injured, but his driver was killed.

In April, gunmen shot Geo News senior anchor Hamid Mir as he and his driver left Karachi’s main airport. Mir survived the attack but sustained wounds to his abdomen and pelvis. His driver survived. The next month, two foreign journalists were expelled from the country after being told their visas would not be renewed. The Hindu correspondent Meena Menon and Snehesh Alex Philip, correspondent for the Press Trust of India, left Pakistan within seven days.

On May 20, some members of Pakistan’s Electronic Media Regulatory Authority (PEMRA) announced that licenses for Geo News, Geo Entertainment, and Geo Tez, channels under the Geo TV Network, had been suspended. Later that day, PEMRA issued a press release saying the order had “no legal standing” since the meeting had been attended by only five of its 12 members.

On June 3, Zafar Aheer, an editor of the Urdu-language Daily Jang, was beaten by six armed men as he was returning home from work. The assailants confiscated his phone and fired shots around his car before fleeing. Aheer told BBC Urdu that the assailants accused employees of the Jang group of being traitors, Jews, and Indian agents. He also said he had received death threats in connection with his affiliation with the media group.

Daily Jang, part of the Jang media group, is headed by Mir Shakil-ur-Rahman, who is also the top executive at Geo TV. Rahman’s outlets have come under increased pressure since Geo TV broadcast allegations that Pakistan’s Inter-Services Intelligence was responsible for the April attack on Mir. Critics said the coverage was irresponsible.

Staffers at the The News–including Umar Cheema, who wrote critically about the attack on Mir–have received threats. Vans carrying Jang’s newspapers have been torched in Lahore, Lodhran, and Rawalpindi.

On June 6, Geo News was fined and given a 15-day suspension by PEMRA. The channel went from providing news to millions of people to a blank screen. PEMRA allowed the channel to begin rebroadcasting after 15 days, but news reports said cable operators were continuing to block the channel.

On June 20, PEMRA suspended Geo Entertainment’s license for 30 days and ARY News’ license for 15 days and imposed on each outlet fines of 10 million rupees. News reports said Geo was banned for “insulting the religious sentiments of viewers” in one of its morning shows, and ARY was banned for “bringing high courts into disrepute” in connection with a critical program.

This sets a very dangerous precedent and opens the door for future attempts to shut down news channels that are critical of the state and its agencies. More than 7,500 people are employed under Geo, and their livelihoods and safety are directly affected by the threats to Geo.

We call on your government to reinstate Geo’s ability to operate and broadcast in the country. Your government should ensure journalists at all news outlets are able to work safely and freely in Pakistan.

The commitments you made provide a clear path forward for media freedom in Pakistan. The recent challenges should not derail your efforts to ensure that journalists are able to do their job without fear.

We left Pakistan with a deep sense of optimism following our mission, and remain hopeful that your government is sincerely committed to ensuring greater press freedoms in the country.

LAHORE: The Council of Pakistan Press Clubs (CPPC), condemning the suspension of licences of Geo TV network, has termed it an illegal act of private members of the Pakistan Electronic Media Regulatory Authority (Pemra).

CPPC Convener Arshad Ansari held an emergency meeting with the presidents of other press clubs of the country in a conference call. They pledged that the CPPC would resist the illegal decision to suspend the licences of Geo News, Geo Entertainment and Geo Tez.

Those who discussed this alarming situation included National Press Club President Shaheryar Khan, Karachi Press Club President Farhan Ahmed Khan, Peshawar Press Club President Nasir Hussain, Quetta Press Club President Raza Rehman, Skardu Press Club President Nisar Abbas, Okara Press Club President Munir Chaudhry, Rajanpur Press Club President Engineer Amjad Farooq, Faisalabad Press Club President Shahid Ali, Chaman Press Club President Noor Zaman Khan, Badin Press Club President Tanveer Ahmed, Hyderabad Press Club President Ishaq Mangreo, Khuzdar Press Club President Ayub Baloch, Kohat Press Club President Fazl Mahmood and others.

Addressing the meeting, Arshad Ansari said the journalists community would not tolerate any attempt to snatch the freedom of press. He said the decision of private Pemra members had put the jobs of thousands of workers of the Jang Group at stake and this would be resisted at all costs.

He said the ban on any media house, including Geo, was not acceptable and the CPPC would launch a movement to foil any such attempt.Meanwhile, the CPPC has decided to ban the entry of private members of Pemra into the press clubs of the country. The CPPC office-bearers said this decision had exposed the Pemra designs against the independent media. They urged the owners of other media houses to remain united at this critical juncture. They warned that other media houses might face the same situation if they didn’t stand united at this crucial point.

ISLAMABAD: The media crisis that has been gripping the nation for a month took a turn for the worse on Tuesday evening when a meeting held by a few members of the Pakistan Electronic Media Regulatory Authority (PEMRA) announced the suspension of three licences — Geo News, Geo Entertainment and Geo Tez — of Geo network.

However, after an hour of statements and counter-statements and utter confusion, the management of the authority said that the meeting itself was illegal, adding that any decisions taken by it were null and void.

The chaos and confusion began on Tuesday evening when Pemra member Israr Abbasi, flanked by other members, Mian Shams and Fareeha Iftikhar, announced their decision to the media waiting in front of Pemra headquarters.

Mr Abbasi announced that the Pemra board had decided to suspend the licences of the three television channels owned by the Geo TV network and ordered that the television channels offices be sealed.

However, he added that the final decision on the revocation of the licences will be announced on May 28, when the next Pemra meeting is to be held which will also be attended by government representatives.

Tuesday’s meeting was not attended by any of the seven government officials who are also part of Pemra’s board. Only the private members representing the four provinces and AJK / GB attended the meeting.

“The Council of Complaints in its meeting held in Karachi today has recommended that the licence of Geo Entertainment be cancelled over its sacrilegious morning show as over 10,000 public complaints were received against it,” Mr Abbasi said, adding that “another complaint has already been received from the ministry of defence against Geo News.”

Geo’s legal troubles include one complaint against the manner in which it accused the ISI of being involved in the attack on journalist Hamid Mir and the morning show which is seen to have hurt religious sentiments.

“All members unanimously decided that the licence for Geo News be cancelled. However, due to a legal formality that could not be completed, we have sent our recommendations to the Council of Complaints, advising that they respond before May 28, the date for our next meeting,” Mian Shams told the media during the briefing.

In the media blitz that followed the Pemra members insisted that their decision was legal and that the channels would have to shut down at midnight.

Fareeha Iftikhar, another member, said that the meeting was legal and the required quorum, under clause 4 of Pemra Ordinance, of one third members had been met – according to her, five out of 12 members attended the meeting.

“In the absence of the chairman, the board is the authority that can take such decisions,” she argued, adding that “Geo will be shut down from tonight and if the channel management does not abide by the board decision, we will approach the courts.”

However, it was not long before another announcement was made, taking the wind out of the assertions made by the five members who attended the Pemra meeting.

A statement issued on the directives of Executive Member Kalimuddin Tipu disowned the decisions announced by Mr Abbasi and others.

This statement was later sent to the press from the government’s Public Information Department, making it clear which side the government stood with.

“It is also clarified that today’s meeting was called without following the laid down procedures and thus had no legal standing. According to Rule 3(4) of Pemra Rules 2009, the Chairman or… at least 07 members can call a meeting. This was an informal meeting attended by five members,” the Pemra press release said.

The spokesman of Pemra said that the decision had no legal validity. It was further pointed out that a meeting could not be held till the law ministry responded. “The meeting was to be held after legal opinion had been received from the law ministry, as was decided in the last meeting held on May 9.”

This view was later upheld by the Information Minister, Pervez Rashid, who also holds the law portfolio. He told Dawn that a meeting could only be called by any two of the three member committee headed by Pervaiz Rathore.

“Incidentally, Pervaiz Rathore and Ismail Shah were missing and Mr Israr Abbasi had already resigned from this committee so how could he have called a board meeting,” the minister added.

At the last meeting, Mr Abbasi had walked out and threatened to quit because his suggestions were being ignored. However, Mr Israr Abbasi continued to stick to his guns and insist that the meeting was legal.

Mir Shakeel moves IHC

Meanwhile, the Chairman of Geo TV, Mir Shakeelur Rehman, moved the Islamabad High Court on Tuesday for quashment of an FIR registered against him for alleged blasphemy and terrorism for airing controversial contents.

Following an order passed by an additional district and sessions judge on May 17, Margalla Police of Islamabad had registered the FIR against Mr Rehman, Geo TV anchor Shaista Lodhi, actress Veena Malik and her husband Asad Bashir Khattak for allegedly profaning holy personages in a programme aired on May 14.

In his petition, Mr Rehman stated that after the airing of the programme, Ms Lodhi apologised more than 26 times; on the contrary a rival channel, ARY News, repeated the same programme over 60 times.

The petitioner stated that because blasphemy laws have become more stringent, there was a tendency to label the accusation of blasphemy by Muslims against Muslims for settling their scores.

He said that he did not play any role in script writing, production or direction of the said episode even then he has been implicated in the case.

The single-judge IHC bench of Justice Shaukat Aziz Siddiqui will hear the matter on Wednesday.
